1. Definitions
In these Terms & Conditions, the following definitions apply:
- "Access Accessibility", "we", "us", or "our" refers to Access Accessibility Pty Ltd (ABN XX XXX XXX XXX).
- "Hirer", "you", or "your" refers to the individual or entity hiring a vehicle.
- "Vehicle" refers to any wheelchair accessible vehicle (WAV) made available for hire.
- "Rental Period" refers to the agreed period of hire as specified in the booking confirmation.
- "Bond" refers to the security deposit held during the Rental Period.
2. Booking Terms
All bookings are subject to vehicle availability and confirmation by Access Accessibility. A booking is not confirmed until you receive a written booking confirmation via email.
To hire a vehicle, the Hirer must be at least 21 years of age and hold a valid, full Australian driver licence (or recognised international licence). Learner and provisional licences are not accepted.
The Hirer must provide accurate personal information at the time of booking, including a valid email address, phone number, and driver licence details. Providing false or misleading information may result in cancellation of the booking without refund.
3. Payment
All prices are quoted in Australian Dollars (AUD) and include GST unless otherwise stated. Payment is required at the time of booking via credit or debit card.
A security bond is required for all rentals. The bond amount will be specified at the time of booking and is held as a pre-authorisation on your payment card. The bond will be released within 7-10 business days after the vehicle is returned in satisfactory condition.
For long-term subscription rentals (rideshare/welfare cab drivers), payments are charged on a recurring weekly or monthly basis as agreed in the subscription terms.
4. Cancellation & Refunds
Cancellations are subject to the following policy:
- More than 48 hours before pickup: Full refund.
- 24 to 48 hours before pickup: 50% refund.
- Less than 24 hours before pickup: No refund.
Access Accessibility reserves the right to cancel a booking at any time due to unforeseen circumstances (e.g., vehicle breakdown, safety concerns). In such cases, a full refund will be provided or an alternative vehicle offered.
5. Vehicle Use
The Hirer agrees to:
- Use the vehicle only for lawful purposes and in a careful and responsible manner.
- Not allow any unlicensed or unauthorised person to drive the vehicle.
- Not use the vehicle for racing, towing, or off-road driving.
- Not smoke in the vehicle. A cleaning fee of up to $250 will apply if evidence of smoking is found.
- Return the vehicle at the agreed date, time, and location with at least the same fuel level as at pickup.
- Report any mechanical issues or warning lights immediately.
- Comply with all road rules and traffic laws. The Hirer is responsible for all fines, tolls, and infringements incurred during the Rental Period.
6. Insurance
All vehicles are covered by comprehensive motor vehicle insurance. The Hirer is responsible for an excess amount as specified in the booking confirmation in the event of any claim.
Insurance cover may be void if the Hirer breaches these Terms & Conditions, including but not limited to: driving under the influence of alcohol or drugs, driving by an unauthorised person, or using the vehicle outside of approved areas.
Third-party damage claims are handled through our insurer. The Hirer must cooperate fully with any investigation.
7. Damage & Accidents
The Hirer must report any damage to the vehicle or any accident involving the vehicle to Access Accessibility immediately. A police report must be obtained for any accident involving injury, third-party damage, or theft.
The Hirer is liable for all damage to the vehicle during the Rental Period, up to the excess amount specified. This includes damage caused by negligence, misuse, or breach of these Terms.
A vehicle condition report (including photographs) will be completed at both pickup and return. Any discrepancies may result in charges against the security bond.
8. Liability
To the maximum extent permitted by Australian Consumer Law, Access Accessibility's total liability for any claim arising from or in connection with a rental is limited to the total rental fees paid by the Hirer for the relevant Rental Period.
Access Accessibility is not liable for any indirect, consequential, or incidental loss or damage, including loss of income, business interruption, or loss of data.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.
9. Privacy
We collect and handle your personal information in accordance with our Privacy Policy and the Australian Privacy Act 1988 (Cth). By making a booking, you consent to the collection and use of your personal information as described in our Privacy Policy.
